Automobile lessor sought declaratory judgment that its contingent liability policy covered independent contractor after repossessing the vehicle. The Seventeenth Judicial Circuit Court, Broward County , Jeffrey E. Streitfeld, J., entered judgment in favor of lessor. Insurer appealed. The District Court of Appeal, Gross, J., held that: (1) lessor “regained custody” when the independent contractor repossessed the vehicle, and (2) exclusion of coverage if the lessor regained custody applied to accident while contractor was driving the vehicle.
Reversed and remanded.
