Insured under life policy brought action against insurer to recover benefits. The Circuit Court, Dade County , Robert P. Kaye, J., directed verdict for insurer at close of all evidence, and appeal was taken. The District Court of Appeal held that issue of whether insurer was bound by agent’s misrepresentations when advising insureds on how to complete policy application was for jury.
Reversed and remanded.
