Motorist who was injured in collision with city police car brought personal injury action against city. Following parties’ agreement to settle claim for $100,000 subject to city’s right to contest motorist’s entitlement to collect from city without submitting special claims bill to state legislature, the Circuit Court, Miami-Dade County, Amy N. Dean, J., entered final judgment for motorist. City appealed. The District Court of Appeal, Wells, J., held that aggregate cap of $200,000 on damages recoverable against city in actions at law arising out of accident was not exhausted prior to present action when, pursuant to settlement agreement, motorist’s passenger received $100,000 from city and legislature passed special claims bill directing city to pay $4.9 million to passenger.

Judgment affirmed.
